تحلیل اقتصادی نظام مسئولیت مدنی و تنظیم گری در مقابله با آلودگی های زیست محیطی

چکیده

هدف اصلی این مقاله توضیح ابزارهای مختلف حقوقی برای جبران آلودگی زیست ­محیطی است. با توجه به این­که از منظر تئوری منفعت عمومی، ابزارهای سنتی حقوقی، مانند مسئولیت مدنی، برای کنترل خطرات زیست­ محیطی کافی نیست، به برخی مداخلات تنظیمی دولت برای کنترل کارآمدتر این مخاطرات نیاز است. با این حال، ضرورت مداخله دولت برای کاهش خسارات زیست‌محیطی، نقش قواعد مسئولیت مدنی را در پیشگیری از بروز این خسارات انکار نمی­ کند. از این رو، سوالی که مطرح می­ شود این است که چگونه مقررات مسئولیت و تنظیم می­توانند به ­طور مشترک برای جبران آلودگی ­های زیست محیطی به­ کار گرفته شوند و چگونه این دو بر یکدیگر اثر می ­گذارند؟ نهایتاً، این سوال باید مطرح شود که کدام یک از قواعد مسئولیت برای داخلی­کردن خطرات زیست محیطی کارآمدتر است؟
