با تأکید بر اینکه امروزه تبعات اجتماعی ، اقتصادی و حقوقی تورم جمعیت کیفری و ازدحام در زندانها، این موضوعات را به پیچیده ترین چالش نظام عدالت کیفری مبدل ساخته است، بازداشت های پیش از محاکمه ، یکی از علل و عوامل اصلی افزایش جمعیت کیفری به شمار می رود ، به گونه ای که تقریباً یک چهارم از جمعیت کل زندانیان در ایران و جهان را متهمین بازداشت شده تشکیل می دهند. بنابراین کاهش شمار و نرخ بازداشت های پیش از دادرسی، به کاهش جمعیت کیفری و بهبود شرایط ازدحام می انجامد.
اصول و استانداردهایی همچون اجتناب از بازداشت های پیش از محاکمه ، اقدامات بازداشتی به مثابه آخرین راه حل ، استفاده حداکثری از تدابیر غیر بازداشتی، اصل برائت ، لزوم وجود مجوز قضایی و رعایت استانداردهای حداقل زمان، از مهمترین اصول ناظر بر بازداشت های پیش از محاکمه در حقوق کیفری ایران همسان با الگوهای بین المللی تعیین گردیده که شناسایی، احصاء و پایبندی به این اصول ، ضمن تضمین حقوق متهمین منتظر دادرسی، کاهش مداخله حقوق کیفری و برون رفت از بحران یاد شده را به دنبال خواهد داشت.
