اصول بنیادین ناظر بر تضمین اصل بی‌طرفی قضایی در نظام بین‌الملل و حقوق ایران

چکیده

اصول استقلال و بی‌طرفی مراجع قضایی از مهم‌ترین مبانی نیل به ‌‌یک دادرسی عادلانه و تأمین حقوق شهروندان در جریان دادرسی هستند که تنها از خلال آنها می‌توان به وجود قوۀ قضائیه و قضاتی عدالت‌پیشه و حق‌مدار امید داشت. این اصول در اکثریت قریب به اتفاق نظام‌های حقوقی داخلی جهان و نیز مقررات حقوقی بین‌المللی، به‌ویژه مقررات خاصِ مربوط به عدالت‌گری مانند اصول بنگلور، شناخته شده است؛ اما برای نیل به استقلال کامل قوۀ قضائیه و قضات هر کشور و نیز بی‌طرفی آنان در هنگام احقاق حق به نظر می‌رسد نیازمند حصول شرایط و اصولی مبنایی و مقدماتی هستیم. بنا بر مطالعات انجام شده در مقررات بین‌المللی و نظام داخلی چندین کشور از جمله ایران، اصولی همچون استقلال نهادی، استقلال فردی قضات، شیوۀ انتصاب قضات و شرایط استخدامی برای تحقق کامل دو اصل استقلال و بی‌طرفی مراجع قضایی می‌توان تعریف و تبیین کرد تا با اِعمال و رعایت آنها استقلال و بی‌طرفی مراجع قضایی در جهت حفظ و حمایت هرچه بیشتر از حقوق شهروندان و موجبات حق بر دادرسی عادلانه فراهم شود.
