چالش های حمایت از نشانه های جغرافیایی در نظام حقوقی ایران؛ فرصت ها و پیشنهادها

چکیده

در نظام حقوقی ایران، از نشانه­ های جغرافیایی در پرتو قانون حمایت از نشانه ­های جغرافیایی مصوب 1383 و کنوانسیون­ ها و موافقت­نامه ­های بین­ المللی همچون کنوانسیون پاریس، موافقت­نامه ­های مادرید و لیسبون حمایت به عمل می­ آید. لیکن، هر کدام از این قوانین دارای خلأها و نارسایی­ هایی بوده که حمایت از نشانه­ های جغرافیایی ایران را با چالش­ های حقوقی جدی مواجه کرده است؛ به طوری که کماکان محصولات اصیل ایرانی در بازارهای داخلی و خارجی مورد سوء استفاده و جعل قرار گرفته و در نهایت سبب گمراهی مصرف­ کنندگان واقعی شده است.
نوشتار حاضر ضمن تبیین مهم ­ترین خلأها و موانع پیش­روی، بر آنست تا فرصت­ ها و راهکارهایی را جهت رفع ناکارآمدی نهاد نشانه­ های جغرافیایی معرفی کرده و پیشنهادهایی برای بهبود وضعیت حقوقی این نشانه­ ها ارائه کند.
