According to Article 23 of the Family Protection Law of 2013 and Article 336 of the Civil Code, the basis for proving Ajr al-Mithl (fair equivalent remuneration) and Clause B of Note 6 of the Single Article Law on the Reform of Divorce Regulations have been established as the foundation for determining Nahla (a form of financial settlement) for a woman’s domestic work. Conversely, according to the Guardian Council’s opinion, based on the parliamentary session records (1991, Session 471, p. 28), since a wife does not perform domestic work with the intention of receiving payment during marriage, she cannot claim compensation afterward. Sunni jurists and some Shia Marjas, citing customary practice, also argue that a woman is not entitled to wages for such work. This article addresses these disagreements and seeks to resolve disputes regarding the aforementioned laws through a critical analysis method, examining legal-jurisprudential evidence, considering jurists’ fatwas, the basis of custom, and existing presumptions of fact. Article 336 of the Civil Code is controversial due to conditions that some consider difficult to prove in practice, and Note 6 of the Single Article Law is disputed for failing to specify the basis for Nahla under prevailing circumstances. This study resolves these conflicts by proving the following: the presumption of a wife’s lack of intent to perform domestic work gratuitously, the non-obligatory nature of domestic work under Islamic law, the erroneous customary assumption denying wages for a wife’s domestic work, the apparent intent to comply with the husband’s directives inperforming domestic tasks, and, finally, by clarifying the true nature of Nahla.
