Intellectual property of online platforms in Iranian and European Union law

Nowadays, the expansion of the use of online platforms has changed the ways of creating, sharing and consuming content, and the rapid growth of these platforms has also caused challenges in the field of their intellectual property rights. The question is, considering the number of actors related to these platforms, who exactly are the intellectual property rights holders and how can their rights be protected?

Iranian law does not include comprehensive regulations that address intellectual property and liability on platforms.; the 1383 E-Commerce Law has addressed this issue in a limited way; but in European Union regulations, including the 2022 Digital Services Law and the 2019 Law on Copyright and Related Rights in the Digital Single Market, specific criteria have been provided for determining liability for intellectual property infringement on online platforms. Although both have made progress in addressing these challenges in the judicial arena, significant gaps remain in their legal frameworks.

By conducting a comparative study between Iranian law and European Union regulations, the present study aims to provide the development of more effective legal frameworks for the protection of intellectual property rights and liability in environments related to these platforms; this goal is pursued using the library research method and by analyzing legal opinions, relevant laws, judicial decisions, and scientific works.
