Artificial intelligence (AI) is a rapidly expanding technology that not only influences but will soon fundamentally transform various aspects of human life, and in some cases, take complete control. This is evident from the numerous systems outlined in the Seventh Development Plan Law (approved in 1403/2024), encompassing dozens of platforms that cover critical, social, economic, legal, and judicial services for all Iranians and residents of the country. While the initial steps in AI development have claimed to enhance welfare and progress, the impacts of AI on social, ethical, and cultural life, human safety and security, the administration of justice, equitable distribution of wealth and power, crime and corruption prevention, employment stability, protection of privacy and personal data, compliance with competition rules in trade and business, and societal psychological security are undeniable. This article, employing a comparative and descriptive-analytical approach, addresses the question: From a legal perspective, how can AI technology be managed to secure and guarantee public rights? The findings of this study, in line with the general obligations of the state to implement and secure public rights under Article 3 of the Constitution and the judiciary’s duty to restore and uphold public rights under Article 156, emphasize the necessity of enacting specific legislation, establishing protections and limitations, creating a regulatory body at the intersection of public rights and the right to development, preventing complete delegation of decision-making and issuance of rulings (administrative, quasi-judicial, and judicial) to machines, and enforcing judicial oversight over this technology in the public sphere.
